TERMS & CONDITIONS / MULTIMEDIA RELEASE TERMS OF AGREEMENT
I, NAME, the parent or guardian of CHILD NAME, on behalf of CHILD NAME, hereby consent and grant permission to Hexco Inc., DBA Hexco Academic (“Hexco”) and Kaplan, Inc. (“Kaplan”) (each a “Party” and collectively, “Parties”) and each of the Party’s respective officers, directors, auxiliary organizations, partners, employees, and agents to take/record, and use, and distribute the voice/audio, image, name, and likeness, and video, or visual images/content of CHILD NAME, including but not limited; and/or to interviews with CHILD NAME and use quotes and information which he/she provides; and/or use any audio/video/visual image/concept ideas produced by CHILD NAME or myself, which I represent that I took or otherwise created.
I agree that Hexco Inc. and Kaplan Inc. owns the audio/video/visual image/interview content collected and all rights related to such content. If I, or CHILD NAME submits content to Hexco Inc., or its auxiliary organizations, I represent that myself, and/or CHILD NAME, created the work(s), have permission to use the work(s) and am not submitting an otherwise unlawful copy, duplication, or reproduction of another person’s work. Content includes, but is not limited to, text, graphics, photos, digital images, drawings, renderings, voices, sounds, music, videos, audio recordings, audiovisual combinations, and any associated or accompanying written communications or descriptions.
I further agree that without notifying me, Hexco Inc. or Kaplan Inc. may use any original or provided audio/video/visual image/interview content at its sole discretion in any print, electronic, or other media or format, including, but not limited to, websites, print or digital publications, presentations, educational courses, videos, film, promotions, broadcasts, advertisements, posters, video signage, radio, and social media. I waive any right to inspect or approve the finished images or any printed or electronic matter that may be used with them.
I further acknowledge that I voluntarily agree to allow CHILD NAME to participate in and/or provide audio/video/visual image/interview Hexco, Inc., Kaplan Inc., and/or any media partners, without the promise of compensation or remuneration in any form whatsoever, and I waive any claim for compensation or remuneration of any kind.
I release Hexco Inc., Kaplan Inc., and any firm authorized to publish, broadcast, and/or distribute a finished product containing the audio/video/visual image/interview content, from any claims, damages, or liability, including attorneys’ fees, that I may ever have in connection with the taking or use of the audio/video/visual image/interview content or material.
I hereby warrant that I am over 18 and a legal competent adult and a parent or legally appointed guardian of the minor CHILD NAME, and that I have every right to contract for CHILD NAME who is a minor in the above regard. I state further that I have read the above authorization, release, and agreement, prior to its execution, and that I am fully familiar with the contents of it. This release shall be binding upon the minor and me, and our respective heirs, legal representatives, and assigns.
